Are Trans Rights Subordinate to Human Rights?

Let’s start by kicking the mule right in the teeth, hit this hotly divisive issue, and ask, whether human rights should be put ahead of trans rights, or vice versa.

This is a complex and contentious issue that often seems to depend on one’s ethical, legal, and philosophical perspectives.

However, It’s important to note that human rights encompass the fundamental rights and freedoms that are inherent to all individuals, regardless of their gender identity or expression.

Trans rights specifically address the rights and protections of transgender individuals, who often face unique challenges and forms of discrimination.

Many argue that human rights should be universal and indivisible, meaning that they apply to all individuals equally, which includes transgender people. They believe that protecting the rights of transgender individuals is an essential component of upholding human rights principles such as equality, dignity, and non-discrimination.

Others may argue that there are situations where the rights of certain groups may appear to conflict, and difficult decisions need to be made. In such cases, prioritization might be based on factors such as legal frameworks, social contexts, or the specific human rights in question.

Are human rights an umbrella, and are transgender or any other group’s rights secondary or subordinate? Is it necessary or even moral to elevate one group’s rights over human rights? And should all rights be of equal priority? What if there is conflict? What methodology do we use to determine what rights have priority?

Do we continue to listen to the talking heads and politicians who can’t help but hide their particular agenda? And frequently display their lack of compassion. respect, or even acknowledgment by voicing their opinions rather than seeking valid scientific and logical methodologies for a common goal?

While it may be fair to say that armed with the scientific studies in the current era on biology, evolution, and other branches of science, many of our arguments would fade away with simple logical reasoning, however, we appear to live in a world where meager opinion has somehow been elevated to an equal plane alongside these rational arguments, and only opinion is exempt from evidence.

ON A SIDE NOTE: it is also crucial to approach these discussions with sensitivity and respect for the dignity and rights of all individuals involved.

It is important to remember that human rights should be universally respected and protected for all individuals, regardless of their gender identity. The goal should be to ensure that every person, including transgender individuals, enjoys equal rights, dignity, and opportunities within society.

Yet before we draw conclusions and mow everyone down with our “feelings” opinions, let’s make way for true scientific study and reasoning. Let’s hold all our ideas accountable to the same standards of evidence. Wouldn’t this level the playing field? Or are we truly that afraid of reality?

Many would claim that the ‘standards of evidence’ need to be different for trans rights, or religion, for example. But how can we have an intelligent, honest conversation toward a mutually beneficial outcome when the goalpost is never in the same place?

Our goal should be to level the playing field rather than to continue to field a team unprepared for the reality of life.

Life is better with evidence, not opinion.
